New CIArb Dispute Board Rules launched by Nicholas Gould

 

The need for prompt, cost-effective and impartial dispute resolution can be found in many contractual relationships in many industries. In order to meet this need, the CIArb have issued the Dispute Board Rules, which cater to any medium or long-term project, whether construction, IT, commercial or otherwise. Nicholas Gould, partner at Fenwick Elliott and Chair of the CIArb Drafting Committee launched these new Dispute Board Rules at the Dispute Appointment Services (DAS) Convention, 14 November 2014.

The invitation-only Convention was designed to gather members of the judiciary, together with a distinguished group of ADR experts, to engage in a high-level discussion of selected topics in the areas of (1) international arbitration, (2) mediation, and (3) construction adjudication. The DAS Convention provided ADR practitioners with a forum to address and discuss practical issues associated with the role performed by dispute resolution professionals - in particular, arbitrators, mediators, and adjudicators. To maximise the opportunity for a meaningful dialogue, the Convention was restricted to Chartered Arbitrators/Fellows of the Chartered Institute of Arbitrators.

Nicholas also led the drafting of CEDR’s “Model Project Mediation Agreement and Model Project Mediation Protocol”.
